Terms of service.

These terms apply when you use Cherish — whether you’re an organiser creating an event or a guest recording a video message. By using the app, the App Clip, or the website at trycherish.app, you agree to them.

1. What Cherish is

Cherish is a video guestbook. An organiser creates an event and shares a link; guests record short video messages; the collection unlocks at a reveal time the organiser chooses. How we handle the data involved is covered by our Privacy Policy, which forms part of these terms.

2. Accounts

Organisers need an account (email/password, Google, or Apple). You must provide accurate information, be at least 13 years old, and keep your sign-in credentials secure — you’re responsible for activity under your account. Guests don’t need an account to record a message.

3. Pricing

Cherish is currently in an early-access launch period and is free to use. We may introduce pricing later. If we do, it will apply to events created after the change — we’ll always show you the price before you commit to a paid event, and we won’t retroactively charge for events created while the service was free.

4. Your content

  • You own your content. Guests own the videos and messages they record; organisers own the event details and photos they upload. Cherish claims no ownership of any of it.
  • You give us a limited licence. So the product can work, you grant Cherish a non-exclusive, worldwide licence to store, process, transmit, and display your content — solely to operate and improve the service (for example: storing a video, generating a thumbnail, streaming it to the organiser). This licence ends when the content is deleted, except for short-lived backup copies.
  • Guests share with the organiser. By submitting a recording to an event, you allow that event’s organiser to watch, keep, and export it. If the organiser enables it, other contributors to the same event may also watch the gallery after the reveal.
  • Organisers are responsible for their event. That includes having any permission needed from the people they invite and from anyone appearing in uploaded photos.

5. Acceptable use

You agree not to use Cherish to:

  • upload or record content that is unlawful, infringing, hateful, harassing, sexually exploitative, or that violates someone else’s privacy or rights;
  • impersonate another person or misrepresent who a message is from;
  • interfere with the service — including probing or circumventing access controls, scraping, reselling access, or attempting to access another event’s videos;
  • upload malware or use the service to distribute spam.

We may remove content or suspend accounts that breach these terms. Where reasonable, we’ll tell you why.

6. Deletion and termination

Organisers can delete their account in the app; deletion is permanent. Organisers and guests can request deletion of individual submissions by emailing hello@trycherish.app. We may suspend or terminate access for breach of these terms, and we may discontinue the service with reasonable notice — if we do, we’ll give organisers a reasonable opportunity to export their videos first.

7. The service is provided “as is”

We work hard to keep Cherish reliable, but the service is provided “as is” and “as available”, without warranties of any kind, express or implied — including fitness for a particular purpose and uninterrupted or error-free operation. Recordings are precious; we still recommend organisers export important videos after the reveal.

8. Limitation of liability

To the maximum extent permitted by law, Cherish will not be liable for indirect, incidental, special, or consequential loss (including loss of data or content), and our total liability for any claim relating to the service is limited to the greater of AUD $50 and the amount you paid us for the event giving rise to the claim in the 12 months before it arose. Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded.

9. Changes to these terms

We may update these terms as the product evolves. We’ll update the date at the top and, for significant changes, notify organisers by email or in the app. Continuing to use Cherish after a change means you accept the updated terms.

10. Governing law

These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
